Gregory J. Irwin, Esq. joins the Firm as Of Counsel

gmueller 835

We are pleased to announce that Gregory Irwin has joined the Firm as Of Counsel.

I was proud to carry his bag for a number of years and now, he will continue the Firm's expansion into personal injury, products liability, professional negligence, and construction litigation.

Mr. Irwin has also represented lawyers in a variety of ethics and disciplinary proceedings. Greg continues to serve as the municipal prosecutor for the Borough of Hillsdale and Westwood. Mr. Irwin received his B.A. from Miami University (Ohio) in 1976. He received his J.D. from Seton Hall Law School in 1979.

In both New Jersey and New York, Greg has been a trial attorney for more years than he cares to count, and is certified by the Supreme Court of New Jersey as a certified civil trial attorney. Certified Civil Trial Attorneys have demonstrated levels of experience, education, knowledge and skill in civil trial practice as recognized by other attorneys and judges familiar with their work. To attain and maintain this designation involved a written examination and ongoing continuing legal education requirements in civil trial law. Less than 2% of New Jersey attorneys are certified by the New Jersey Supreme Court.

Mr. Irwin served as law clerk to Hon. Leonard D. Ronco, Judge, Superior Court of New Jersey, Law Division, Essex County for the 1979-1980 term. Mr. Irwin was an Assistant Prosecutor in Bergen County from 1980-1982, and is a former member of the District Ethics Committee for Bergen County.

Mr. Irwin is admitted to practice before the courts of the State of New Jersey, the United States District Court for the District of New Jersey, the courts of the State of New York, the United States Court of Appeals for Third Circuit, the United States District Court for the Eastern District of New York and the United States District Court for the Southern District of New York.

Mr. Irwin is a member of the New Jersey State Bar Association, the Bergen County Bar Association, the Hudson County Bar Association, the New York State Bar Association, the American Trial Lawyers Association, Trial Lawyers of New Jersey, the American Arbitration Association as well as a Senior Fellow of the Litigation Counsel of America, The Trial Lawyer Honorary Society.

Mr. Irwin has been named by New Jersey Super Lawyers® magazine as one of the top attorneys in New Jersey since 2009. The usual disclaimers apply.

Greg will be happy to hear from you at (201) 569-2533 or girwin@gdm-law.com

Geoffrey D. Mueller, Esq. Appointed as Panel Chair of the Bergen County District IIB Fee Arbitration Committee

Effective October 1, 2016, Geoffrey D. Mueller, Esq. has been appointed as Panel Chair of the Bergen County District IIB Fee Arbitration Committee. As the Panel Chair, Mr. Mueller is charged with overseeing and resolving attorney fee disputes in District IIB of Bergen County.

As an alternative to lawsuits regarding attorney's fees, the Supreme Court of New Jersey has established the fee arbitration process as a low-cost and efficient method to resolve such disputes. District fee arbitration committees throughout New Jersey are maintained by volunteers, with the goal of resolving, through binding arbitration, disputes over attorney fees. Fee arbitration is impartial and inexpensive, and the arbitration process is typically resolved more quickly than a court case. The fee arbitration process may be less stressful for all involved, since it is less formal and designed to bring matters towards their conclusion in a straightforward, time-saving, and efficient way.

Geoffrey D. Mueller, Esq. Honored by (201) Magazine As 2016 Top Lawyer For Chancery Practice

Once again, we are honored by our peer recommendations and extend our thanks to those attorneys as well as our clients and friends, without whom, none of this would be possible.

The Law Offices of Geoffrey D. Mueller, LLC is proud to announce that Geoffrey D. Mueller, Esq. has been honored as a 2016 Top Lawyer in the area of Chancery Practice by (201) Magazine.  Per (201) Magazine:

(201) Magazine presents the results of the annual Bergen’s Top Lawyers peer-review survey, conducted by Professional Research Services (PRS) of Royal Oak, Mich. Thousands of attorneys throughout Bergen County were contacted by PRS and asked who they would recommend within the county in given areas of law. Via an online ballot, each attorney was allowed to recommend up to three colleagues in each given legal specialty. (Note: The opinions are not those of (201) Magazine, BergenCounty.com, North Jersey Media Group or any of its employees.)

Once the online nominations were complete, each nominee was carefully evaluated on the basis of the survey results, the legitimacy of their license and their current standing with the State Bar Association of New Jersey. Attorneys who received the highest number of votes in each specialty are listed in alphabetical order.

We are humbled and thank you for the continued opportunity to be of service.

It Won't Cure His Cancer, But Send 5 Year-Old Danny Nickerson Birthday Cards By July 25, 2014

Per WCVB (Boston):

FOXBOROUGH, Mass. —It’s not the cake, presents or party that gets Danny Nickerson excited for his sixth birthday on July 25 – it’s the cards.

The Foxborough boy diagnosed with inoperable brain cancer last fall has had to stop going to kindergarten, his family tells ABC News. But when he’s feeling lonely, nothing cheers him up like a card with his name on it.

“He can recognize his name now,” mom Carley Nickerson told ABC News. “When he saw his name on the package from magical fairies on Easter, he was so happy.”

Danny Nickerson underwent 33 radiation treatments after his October diagnosis and he’s now getting chemo therapy every two weeks, according to ABC. His doctors say children with his type of cancer rarely live longer than 18 months.

Cards can be mailed to Danny Nickerson, P.O. Box 212, Foxborough, MA, 02035.

Memorial Day: In Memory & Celebration

Per USMemorialDay.org:

Maj. Gen. John A. Logan's General Order No.11, WASHINGTON, D.C., May 5, 1868

HEADQUARTERS GRAND ARMY OF THE REPUBLIC

The 30th day of May, 1868, is designated for the purpose of strewing with flowers or otherwise decorating the graves of comrades who died in defense of their country during the late rebellion, and whose bodies now lie in almost every city, village, and hamlet church-yard in the land. In this observance no form of ceremony is prescribed, but posts and comrades will in their own way arrange such fitting services and testimonials of respect as circumstances may permit.

We are organized, comrades, as our regulations tell us, for the purpose among other things, "of preserving and strengthening those kind and fraternal feelings which have bound together the soldiers, sailors, and marines who united to suppress the late rebellion." What can aid more to assure this result than cherishing tenderly the memory of our heroic dead, who made their breasts a barricade between our country and its foes? Their soldier lives were the reveille of freedom to a race in chains, and their deaths the tattoo of rebellious tyranny in arms. We should guard their graves with sacred vigilance. All that the consecrated wealth and taste of the nation can add to their adornment and security is but a fitting tribute to the memory of her slain defenders. Let no wanton foot tread rudely on such hallowed grounds. Let pleasant paths invite the coming and going of reverent visitors and fond mourners. Let no vandalism of avarice or neglect, no ravages of time testify to the present or to the coming generations that we have forgotten as a people the cost of a free and undivided republic.

If other eyes grow dull, other hands slack, and other hearts cold in the solemn trust, ours shall keep it well as long as the light and warmth of life remain to us.

Let us, then, at the time appointed gather around their sacred remains and garland the passionless mounds above them with the choicest flowers of spring-time; let us raise above them the dear old flag they saved from hishonor; let us in this solemn presence renew our pledges to aid and assist those whom they have left among us a sacred charge upon a nation's gratitude, the soldier's and sailor's widow and orphan.

It is the purpose of the Commander-in-Chief to inaugurate this observance with the hope that it will be kept up from year to year, while a survivor of the war remains to honor the memory of his departed comrades. He earnestly desires the public press to lend its friendly aid in bringing to the notice of comrades in all parts of the country in time for simultaneous compliance therewith.
Department commanders will use efforts to make this order effective.
By order of

JOHN A. LOGAN,
Commander-in-Chief

N.P. CHIPMAN,
Adjutant General

PreventDUI.AAA.com is an online resource offering impaired driving facts, transportation alternatives and expert advice.  Once there, AAA encourages visitors to Take the Pledge to drive drug and alcohol-free.

NORAD Tracks Santa

Per NORADSanta.org:

"For more than 50 years, NORAD and its predecessor, the Continental Air Defense Command (CONAD) have tracked Santa’s flight.

"The tradition began in 1955 after a Colorado Springs-based Sears Roebuck & Co. advertisement misprinted the telephone number for children to call Santa. Instead of reaching Santa, the phone number put kids through to the CONAD Commander-in-Chief's operations "hotline." The Director of Operations at the time, Colonel Harry Shoup, had his staff check the radar for indications of Santa making his way south from the North Pole. Children who called were given updates on his location, and a tradition was born.

"In 1958, the governments of Canada and the United States created a bi-national air defense command for North America called the North American Aerospace Defense Command, also known as NORAD, which then took on the tradition of tracking Santa.

"Since that time, NORAD men, women, family and friends have selflessly volunteered their time to personally respond to phone calls and emails from children all around the world. In addition, we now track Santa using the internet. Millions of people who want to know Santa's whereabouts now visit the NORAD Tracks Santa website.

"Finally, media from all over the world rely on NORAD as a trusted source to provide updates on Santa's journey.

"In Memory of Retired Colonel Harry Shoup, NORAD's First Santa Tracker:

Geoffrey D. Mueller, Esq. Joins New Jersey Guardianship Monitoring Program

Effective immediately, the Law Offices of Geoffrey D. Mueller is proud to announce that Geoffrey D. Mueller will be volunteering as a member of the New Jersey Guardianship Monitoring Program.  "The New Jersey Judiciary Guardianship Monitoring Program (GMP) is a comprehensive statewide volunteer-based court program established to monitor guardians in their handling of the affairs of incapacitated individuals, including elderly and developmentally disabled adults.

"The goal of the GMP is to safeguard and reduce the potential for abuse and exploitation of incapacitated individuals by their guardians. The program is committed to helping ensure that these vulnerable members of society are treated with dignity and respect, while also assisting guardians in their sometimes difficult role.

"The GMP monitors guardianship cases to ensure that guardians of incapacitated persons are performing their duties appropriately. Monitoring and oversight of guardianships helps identify, address, prevent, and deter activities that are harmful to incapacitated individuals.

"Trained GMP volunteers use the Guardianship Monitoring System (GMS), a computer application comprised of a statewide guardianship database and a report review tool, to track and follow up on guardianship files. The volunteers’ work ensures that guardians comply with statutory and court-ordered requirements to file documents and reports and manage the affairs of incapacitated individuals effectively."

"The program, which is expected to be statewide by June 2014, is currently in four counties – Hunterdon, Passaic, Burlington and Mercer. Prospective volunteers in other counties will be kept informed about the start of the program in their counties.

In Thanks For Our Veterans - General Pershing's address to the American Expeditionary Forces

Per Army.Mil:

AEF GHQ General Order 203, 12 November 1918 - General Pershing's address to the American Expeditionary Forces

"The enemy has capitulated. It is fitting that I address myself in thanks directly to the officers and soldiers of the American Expeditionary Forces, who by their heroic efforts have made possible this glorious result.  Our Armies, hurriedly raised and hastily trained, met a veteran enemy, and by courage, discipline and skill always defeated him. Without complaint you have endured incessant toil, privation and danger. You have seen many of your comrades make the Supreme Sacrifice that freedom may live.  I thank you for your patience and courage with which j-ou have endured. I congratulate you upon the splendid fruits of victory, which your heroism and the blood of our gallant dead are now presenting to our nation. Your deeds will live forever on the most glorious pages of America's history.

"Those things you have done. There remains now a harder task which will test your soldierly qualities to the utmost. Success in this and little note will be taken and few praises sung; fail, and the light of your glorious achievements of the past will be sadly dimmed.  But you will not fail. Every natural tendency may urge towards relaxation in discipline, in conduct, in appearance, in everything that marks the soldier. Yet you will remember that each officer and each soldier is the representative in Europe of his people and that his brilliant deeds of yesterday permit no action of today to pass unnoticed by friend or foe.  You will meet this test as gallantly as you met the test of the battlefield. Sustained by your high ideals and inspired by the heroic part you have played, you will carry back to your people the proud consciousness of a new Americanism born of sacrifice.  Whether you stand on hostile territory or the friendly soil of France, you will bear yourself in discipline, appearance and respect for all civil rights that you will confirm for all time the pride and love which every American feels for your uniform and for you."

New Jersey’s Second Medicinal Marijuana ATC Opens In Egg Harbor

Per The Star Ledger:

"Days before the second medicinal marijuana shop opens in New Jersey, the dispensary’s owners held a building dedication ceremony yesterday in memory of an ardent patient advocate who helped get the law passed but died before she could become a customer.

"Diane Riportella’s family, friends and fellow advocates gathered at Compassionate Care Foundation, Inc. in Egg Harbor Township to pay tribute to her efforts that help persuade state lawmakers to legalize medical marijuana in 2010."

***

"Some 600 patients have elected to use the Egg Harbor facility as their dispensary, Thomas said. The Health Department has asked Compassionate Care to meet with patients in the order in which they signed up, he said, noting that some people have been waiting a year.

"About 130 patients have been served at Greenleaf Compassion Center in Montclair."

Dogfish Head Announces Release of American Beauty Imperial Pale Ale

With all of the frustrating events in Washington, here's something we can all agree is good news:

Per Dogfish.com:

"There was something different about a Grateful Dead show. Whether you saw one or 100, you felt it, but you knew it wouldn't last forever. If only you could have bottled it....

"American Beauty, an Imperial Pale Ale inspired by the Grateful Dead, captures the spirits of the band's 30 years of touring and recording. Dogfish Head and the Dead both built their followings by connecting directly with beer lovers and music lovers, so we asked those loyal fans to help drive the recipe.

"For more than 1,500 ingredient suggestions, organic granola was tops. It was the main course in millions of parking lot meals and is a sweet and toasty complement to the barley and all-American hops."

Boston Globe: Wiffle Ball Event a Big Hit for Travis Roy Foundation

Per The Boston Globe:

"ESSEX, Vt. — Konnor Fleming makes a spectacular game-ending catch in the 12th Travis Roy Wiffle Ball Tournament, catapulting headfirst into the right-field bullpen at Little Fenway Park, and vanishing from sight.

"When he finally surfaces, Travis Roy breathes a sigh of relief.

“It did cross my mind that I hope he didn’t just break his neck,” says Roy, who was watching from his wheelchair.

"It has been nearly 18 years since Roy, 38, crashed headfirst into the boards at Walter Brown Arena, just 11 seconds into his first shift as a Boston University hockey player, and became a quadriplegic. Today, Roy remains paralyzed from the neck down, with just enough movement in his right arm to operate the joystick of his motorized wheelchair."

***

"Roy, who lives in Boston, heard one of the explosions from the Boston Marathon bombings from his apartment. He knows the trauma the survivors are going through. When he was in the hospital after his accident, a peer counselor with quadriplegia visited and told him everything was going to be fine.

“I said, ‘Get the [expletive] out of my room,’ ” says Roy. “I just wasn’t ready to hear it. You’ve got to deal with losses and feel the pain. But life has gotten a hell of a lot better than I thought it would.”

"To help survivors, he penned an article for WBUR.

“My advice to those who are injured is to cling to those things that still put a smile on your face, and build from there,” he wrote."

Patients & Caregivers in New Jersey's Medicinal Marijuana Program
Can Register with Egg Harbor ATC Beginning Monday

Trenton, NJ - In anticipation of the September opening of the Compassionate Care Foundation (CCF) Alternative Treatment Center (ATC) in Egg Harbor Twp., patients and caregivers will be able to register with this ATC on the New Jersey Medicinal Marijuana Program's webpage beginning Monday, August 5, 2013, Health Commissioner Mary E. O'Dowd announced today.

Beginning Monday, patients will be able to choose between two ATCs based on geographic location, the quality of service, type of product or any other considerations patients may have.

CCF will schedule patient appointments in the order in which patients registered with the MMP. CCF expects to dispense product after mid-September.

"Patients will now have more options in terms of locations and types of product, which some patients and caregivers have said they would prefer," said Commissioner O'Dowd. "One of the strains CCF is growing has a high cannabidiol (CBD) content and is low in THC (tetrahydrocannabinol)."

Patients can choose any ATC regardless of where they live. Patients can change ATCs at any time and it does not require a new identification card. There is no cost to change ATC registration, but patients only register with one ATC at a time.

The Department issued Compassionate Care Foundation (CCF) a permit to cultivate on June 6, 2013 and has been working closely with CCF toward a September opening.

Patients and caregivers can reach the CCF customer service department by calling (609) 277-7547 or visiting its website at http://ccfnj.org/.

The MMP has reached out to registered patients with instructions on how to change their registration. Information and instructions on the Patient Initiated ATC Selection Process can be found on the Department's MMP webpage. Patients may also contact the MMP Customer Service Unit at (609) 292-0424.

2013 NJ Fireworks Guide - Best of NJ

Divided by county and town (or date), the Best of NJ 2013 Fireworks Guide is an easy, comprehensive guide to fireworks displays in your area. Per Best of NJ:

"The 2013 N.J. Fireworks Guide is a work in progress....We’ve been getting helpful information from our readers and great responses from town clerks all over the state and we’ll be working every day up to the 4th and beyond since there are so many displays this on Friday the 5th, Saturday the 6th and Sunday the 7th.

"This year we’re in a particularly rainy period and firework displays are being rescheduled every day. In order to keep up with this, we are rechecking our reports daily and doing updates several times a day.

"We’ve divided up the fireworks guide into different regions, counties and cities. Our old guide was just too big and clumsy to read. (sort of like carrying a set of encyclopedias to the beach) We also advise you to check the information on each event yourself before you travel any great distance. Fireworks displays do get cancelled and you should confirm the details if the weather looks iffy."

Maj. Gen. John A. Logan's General Order No.11, WASHINGTON, D.C., May 5, 1868

Per USMemorialDay.org:

HEADQUARTERS GRAND ARMY OF THE REPUBLIC

General Orders No.11, WASHINGTON, D.C., May 5, 1868

"It took years to reach the $25 billion settlement between the nation’s largest lenders and 49 states, but affected homeowners were only given months to claim their piece of the pie.

"So this is a reminder to anyone who [lost] their home due to foreclosure between Jan. 1, 2008 and Dec. 31, 2011, and whose loans were serviced by any of the following at the time — Wells Fargo, JPMorgan Chase, Ally/GMAC, Citi, Bank of America. The deadline to file your claim is Friday, Jan. 18."

To all of those who have helped get the Firm off the ground this past year, we offer our sincerest thanks and gratitude.  It remains our pleasure to be afforded the opportunity to be of service, and we wish you and yours nothing but the best in 2013.

For those interested, courtesy of Becky Sue Epstein at Bloomberg.com:

"Ever wonder why we celebrate New Year’s Eve with champagne? The answer dates back at least 1,500 years. And it involves a mix of history, location and -- not least -- skillful marketing.

"In the late fifth century, King Clovis, the reigning monarch of northern France, was fighting to defend his territory. Legend has it that he promised his wife, the Burgundian princess Clotilde, that if he won his next battle, he would convert to Christianity. He won, and in 496 he was baptized in a church in the city of Reims, in the heart of France’s Champagne region.

"For centuries afterward, kings of France were crowned in Reims, eventually at a great cathedral built there. Before trains and cars, trekking out to Reims was a major undertaking. So, after a coronation, the royal court would linger in the Champagne region for a while, and partake of the local wines.

"In the Middle Ages, the wine world was very different from what it is today. Like other agricultural products, wine was commonly consumed within a year after it was produced. Grapes were harvested and fermented for a few weeks, then exported during the fall and winter, usually shipped in barrels. The wines of Champagne at the time were “still,” not effervescent as champagne is today."

NORAD Tracks Santa

Per http://www.noradsanta.org/en/aboutSanta.html

About Santa

Santa reading The Night Before Christmas

Santa keeps a long list of children who have been good throughout the year. His list grows longer each year due to the world's increasing population. Check out the world’s population right now.

Though his list gets longer, Santa still has to deliver all of the presents in the same amount of time. If one were to assume he works in the realm of standard time, he would need to limit his stay to about three
ten-thousandths of a second per home!

Santa Claus is more than 16 centuries old, yet he does not appear to age at all. This is our biggest
clue that he does not work within time as we know it. His whole trip may appear to us as taking
only 24 hours, but to Santa it may last days, weeks or even months in standard time!

Santa would never rush the important job of distributing presents to children and spreading
holiday cheer to everyone, so the only logical conclusion is that Santa functions within a
different time-space continuum than the rest of us. Santa is a true mystery to us all!

Is he real?

Based on historical data and more than 50 years of NORAD tracking information, we believe that
Santa Claus is alive and well in the hearts of children throughout the world.

Santa Claus is known by many names, including Saint Nick. Historians claim that the history of
Santa starts with the tradition of Saint Nicholas, a 4th century Christian priest who lived in the
Middle East and became famous for his kindness. He was known for giving gifts to the less
fortunate, sprinkling gifts of gold down people's chimneys, and for hiding surprises in their stockings.

It may be that the Santa we know today emerged from the legacy of Saint Nicholas. Clearly, Santa's
basic approach to gift giving is strikingly similar. Could they be the same person? Only Santa Claus
knows for sure!

Long before the Wright brothers flew the first airplane or the Montgolfier brothers launched the first
hot air balloon, Santa had to find a way to travel from house to house at great speed. We know from
our Santa Cam images that Santa’s choice for quick transportation was a herd of flying reindeer.
Detailed information on these reindeer remains elusive; we do know, however, that Santa enlisted
the reindeer to help him with his worldwide mission of gift-giving. A veil of sweet mystery hides the rest.

Virginia's Letter to Santa

Virginia’s letter, written in December 1897, is the most famous
example of a child wanting to know about Santa.

New Jersey Judiciary - Complimentary Emergent Case File Reconstruction

The New Jersey Judiciary is providing emergent case file reconstruction assistance for those attorneys and self-represented litigants whose case files have been destroyed or damaged by Hurricane Sandy.  Those affected attorneys and self-represented litigants can request from the Judiciary, at no cost:  (a) a listing of their active cases, and (b) copies of court documents in specific active cases, by completing the Active Case File Recovery Assistance -- Emergent Hurricane Sandy Request Form.  (Click on form or go to www.judiciary.state.nj.us/forms/11655_casefile_recover_sandy.pdf to access the Active Case File Recovery Assistance -- Emergent Hurricane Sandy Request Form).  Please see the Notice to the Bar below for more information.

NOTICE TO THE BAR
EMERGENT ASSISTANCE FOR ATTORNEYS AND SELF-REPRESENTED LITIGANTS --
RECONSTRUCTING ACTIVE CASE FILES DAMAGED OR
DESTROYED BY HURRICANE SANDY AT NO COST TO THE REQUESTER

The destruction in New Jersey caused by Hurricane Sandy included damage to and destruction of active case files maintained by attorneys and self-represented litigants in areas affected by the hurricane and its aftermath. To assist those affected attorneys and self-represented litigants to reconstruct their lost or damaged files, the Judiciary is providing an emergent assistance process by which those affected can request, at no cost: (a) a listing of their active cases, and (b) copies of court documents in specific cases.
An "active" case file for these purposes is defined as follows:

·    Any Superior Court matter that has an "active" status in the court's case management system. These are matters that have not been marked settled, dismissed, or those where judgment/summary judgment has not been entered, any matter where the time to appeal has not yet expired, any matter post-judgment that has an active writ, any matter post-judgment that has a proceeding or application pending before the court, or any matter where an application to the court cannot be made without obtaining new copies of documents in the court's files;
·    Any docketed judgments where the statutory period of the judgment (generally 20 years) has not expired, where a judgment was revived prior to the expiration date and the revival is still within the statutory period, or where the statutory period is expired but has been tolled, or extended, by the court;
·    Any Municipal Court cases that have not been disposed of; and
·    Any case pending a decision of the Tax Court, Appellate Division, or Supreme Court; in these courts, however, the need for copies of documents will be evaluated on a case-by-case basis regardless of the status of the case.

Affected attorneys and self-represented litigants can request a list of their active cases by completing the Active Case File Recovery Assistance -- Emergent Hurricane Sandy Request Form. The form can be accessed on the Judiciary's website and the New Jersey Bar Association's website.  The completed form can then be submitted to SCCO via a new dedicated email address (RequestsForRecordsDestroyedByHurricaneSandy.Mailbox@judiciary.state.nj.us).

This same form can be used to request copies of specific case files. Priority will be given to those requests in cases with upcoming trials or other emergent needs.

Adversaries of attorneys and self-represented litigants in cases affected by this hurricane-related loss of files are encouraged to assist in reconstructing those case files to the extent possible, thereby allowing for a more complete reconstruction of case files to include documents not contained within the court's files.

New Jersey Supreme Court Tolls Filing Deadlines for Hurricane Sandy

Per the New Jersey Law Journal:

"In the aftermath of Hurricane Sandy's devastating impact on New Jersey, the state Supreme Court has issued a tolling order allowing more time to meet filing deadlines.

"Chief Justice Stuart Rabner ordered on Nov. 9 that in computing time periods for purposes of court rules or statutes of limitation, the span from Oct. 29 — the day the storm hit — through Nov. 16 'shall be deemed the same as legal holidays.'

"Documents that had to be filed during those three weeks will be treated as on time if they are filed by Nov. 19."

Hurricane Sandy - Various Updates

To those who have been affected by the storm and its aftermath, please accept our sincere condolences and best wishes. If there is anything we might be able to do in order to help you and yours get through these times, please do not hesitate to contact us. We hope the following information proves useful.

Power Restoration Estimates:

Per http://www.nj.com/news/index.ssf/2012/11/here_are_town-specific_plans_o.html#incart_m-rpt-2

"As of this morning, just over 1 million people in New Jersey remained without power, including 493,000 PSE&G customers, 485,000 JCP&L customer, and 10,000 Atlantic City Electric customers.

Nearly half of Rockland Electric’s 70,900 customers in Bergen, Passaic and Sussex counties are without power, but the New York-based utility was not asked to provide restoration times to the state, officials said."

Voting:

"Trenton, NJ – The New Jersey Department of State has issued a directive today to county elections officials to permit New Jersey registered voters displaced by Hurricane Sandy to vote electronically. This directive also is intended to assist displaced first responders, whose tireless recovery efforts away from home has made voting a challenge.

“This has been an extraordinary storm that has created unthinkable destruction across our state and we know many people have questions about how and where to cast their vote in Tuesday’s election. To help alleviate pressure on polling places, we encourage voters to either use electronic voting or the extended hours at county offices to cast their vote,” said Lt. Governor Kim Guadagno. “Despite the widespread damage Hurricane Sandy has caused, New Jersey is committed to working through the enormous obstacles before us to hold an open and transparent election befitting our state and the resiliency of its citizens.”

"To vote electronically, displaced voters may submit a mail-in ballot application either by e-mail or fax to their county clerk. Once an application is approved, the clerk will electronically send a ballot to the voter by either fax or e-mail in accordance to the voter’s preference. Voters must return their electronic ballot – by fax or email – no later than November 6, 2012, at 8 p.m.

"Voters can download a mail-in ballot application for their county by visiting http://nj.gov/state/elections/voting-information-vote-by-mail.html. A list of county clerk websites, phone numbers and fax numbers are available by visiting http://nj.gov/state/elections/voting-information-local-officials.html."

"Trenton, NJ – The Christie Administration is encouraging New Jersey voters to take advantage of the extended weekend hours at New Jersey’s county elections offices to cast their vote before Election Day. Registered New Jersey voters can vote in-person by visiting their county clerk’s office no later than 3 pm Monday.  Once they receive a ballot from their clerk’s office, voters will be able to complete their ballot and immediately deliver it to their county board of elections office. In a directive issued yesterday by Lt. Gov. Kim Guadagno, county election offices are to remain open, at a minimum, from 8:30 am to 4:30 pm beginning November 2 until November 5, and are to take all reasonable measures to inform voters of the extended hours.

“The extent of Hurricane Sandy’s destruction is impossible to fully describe,” said Lt. Governor Guadagno, who serves as Secretary of State and is responsible for overseeing the Division of Elections. “For many New Jerseyans, the hurricane’s impact may have made Election Day the last thing on their minds, but we want to make voting as easy as possible considering the devastating circumstances. Despite the devastation that surrounds many of our citizens, we are committed to upholding and honoring our nation’s ideals and having an open and transparent election.”

Pouring Ribbons To Open September 14, 2012

Per TimeOut.com:

The hotshot cocktail team behind Alchemy Consulting—Toby Maloney, Jason Cott, Troy Sidle and Death & Company vet Joaquín Simó—open a grown-up watering hole determined to outgrow the speakeasy genre this Friday the 14th. Painted blue and green, the airy 88-seat East Village room is lit with white-frosted Art Deco glass shafts and a large arched window spanning the front of the bar. The cocktail menu, laid out as a chart with drinks mapped across categories like "Comforting" and "Refreshing," features originals such as the Tahona Smash, a light mixture of reposado tequila, dry sherry, caramelized pear and Angostura bitters. 225 Ave B between 13th and 14th Sts (917-656-6788).

Per The New York Times:

POURING RIBBONS The men of Alchemy Consulting — Toby Maloney, Jason Cott, Troy Sidle and the former Death & Co. bartender Joaquín Simó — are creating an 88-seat second-floor cocktail den in the East Village (above a liquor store, appropriately). The menu will stay brief, at 15 drinks or so, but change every four to six weeks, reflecting the time of year and whatever the bartenders happen to be working on. The team aims to create an airy, convivial local place with intimate banquettes at the front and bar seating at the back. (September): 225 Avenue B, second floor (East 14th Street), (917) 656-6788.

Per New York Magazine:

Details are scant, but here’s what the latest from Alchemy Consulting’s Troy Sidle will not be: “a speakeasy, neo-speakeasy, or any kind of twenties throwback.” Sidle, who has parterned with Death & Co.’s Joaquín Simó and two others, says the 88-seat bar will serve exactingly simple cocktails, and a controlled door means you’ll always get a seat.

Bright Side Manor's Bergen Avenue Project Continues To Gather Momentum

Per The Teaneck Suburbanite Through The Bergen Record:

"Teaneck BOA approves plans for senior housing project

"A major obstacle that had blocked development of an assisted living facility for low-income seniors has been cleared.

"At the June 21 meeting, the Board of Adjustment approved plans for building the 64-unit, three-story building at 60 Bergen Ave. after Geriatrics Services Inc., the not-for-profit developer of the project, presented plans to build an access road into the property from Queen Anne Road in Bogota.

"In February 2011, the BOA approved the project to be built on a 1.5 acre vacant lot bordered on the east by Bergen Avenue in Teaneck and the west by Queen Anne Road in Bogota, but had required that developer add a rear access to the building from Bogota. But the requirement seemed impossible to meet because the Bogota side of the property is bordered by a convenience store and a Luke Oil [sic] station, and neither property owner was willing to sell the land.

"Elizabeth Davis, principal of Geriatrics Services, appealed the BOA decision in Superior Court and lost. The project seemed dead until the owner of the Luke Oil station agreed to give Geriatrics Services a perpetual easement, permitting a 25 by 150 foot road from Queen Anne Road into the property.

"The easement will be filed with the county and will remain in force, even if the property is sold. Davis declined to say how much Geriatric Services paid for the easement, but said that the organization would pay part of the taxes."

Bright Side Manor Receives Clearance To Build New Facility

Per The Bergen Record:

"A long-stalled project to build 65 housing units for low-income seniors may finally move forward after the Zoning Board of Adjustment voted Thursday to approve a developer’s plan to put a roadway through another person’s property as a second access to the development.

"But there is still a remaining wrinkle: The approval is contingent upon a number of factors, including a written contract with the owner of the Queen Anne Road property giving the piece of land to the developer, Geriatric Services Inc., to use in perpetuity as a roadway."

Binky Philips & Rhino Records Release "My Life In The Ghost of Planets: The Story of a CBGB Almost-Was"

Binky Philips amp Rhino Records Release quotMy Life In The Ghost of Planets The Story of a CBGB AlmostWasquot
"The actual zygote moment of The Planets' inception took place, beyond appropriately enough, at The Who's first full length concert in New York City on July 8,1967. The dilapidated Village Theater on 2nd Ave and 6th St was less than a year away from becoming the Fillmore East. Anthony and I had tickets in the center of the 15th row and...

"We'd politely sat through Richie Havens, but, the next act up was simply dreadful. They were a dishwatery folk-rock band called Chrysalis, with a wispy blond "chick" singer who, although pretty, stood stock still, and had a listless little voice to match. Anthony and I, two brats from Brooklyn, started heckling, "We Want The Who!" When Anthony yelled out "Get off the stage, you statue!", the older guy sitting next to me burst out laughing and said, "Oh man, I love you guys! I'm John."

"Super handsome, a bit like Sam Andrew in Big Brother, with the longest hair I'd ever seen on a guy, John was 19. We were 14. We three were all full-blown Who loons. A friendship spontaneously combusted in the 15th row.

"It's hard to fathom these days, but, lifelong friendships could be based on the mutual love for that band. I have never been able to fully analyze it, but, there was, among The Who's early fans (pre-Tommy, '65-'68), a sense that you were in on some cosmic secret. John Taylor, Anthony Jones, and I were in on that secret -- deeply, religiously so."

In Flanders Fields

In Flanders fields the poppies blow
Between the crosses, row on row
That mark our place; and in the sky
The larks, still bravely singing, fly
Scarce heard amid the guns below.
We are the Dead. Short days ago
We lived, felt dawn, saw sunset glow,
Loved and were loved, and now we lie
In Flanders fields.

Take up our quarrel with the foe:
To you from failing hands we throw
The torch; be yours to hold it high.
If ye break faith with us who die
We shall not sleep, though poppies grow
In Flanders fields.

(John McCrae, c. 1915)

***

We cherish too, the Poppy red
That grows on fields where valor led,
It seems to signal to the skies
That blood of heroes never dies.

(Moina Michael, c. 1915)
